The Employment Pass (EP) is a work permit that enables an expatriate to take up employment with an organisation in Malaysia. The pass is subject to the contract of employment (up to 60 months). The Expatriate Committee (EC) or relevant authorities must give approval for the foreign talent to fill a position before the issuance of an expatriate Employment Pass can be made by the Immigration Department of Malaysia.
Governed by the Expatriate Services Division (ESD) which is under the the Immigration Department of Malaysia. The ESD cooperates and works with Talent Corporation Malaysia Berhad (TalentCorp), Ministry of Home Affairs, Ministry of Foreign Affairs, Public Service Department, Securities Commission of Malaysia, Royal Malaysian Police Department, and Ministry of International Trade and Industry.
The preference to foreign talent employed in the 12 industries under National Key Economic Areas (NKEA) as outlined in the Economic Transformation Programme (ETP) of the Malaysian Government are:
The employers are usually in touch with the ESD in handling the processes and procedures of employing foreign employees. However, it can be complex and if improperly handled, it can result into delays and inefficiencies, which can be disadvantage for both the foreign employers and employees.
This type of Malaysia work permit can be issued for 1-5 years, depending on the specific case or work duration, and it is renewable.
